TERMS AND CONDITIONS FOR THE USE OF THE WEBSITE AND PRODUCTS OF JRK CONSULT LTD (THE “COMPANY”)
Please read these Terms and Conditions carefully before using any of the products and/or services of JRK Consult Ltd or our website (www.destinationagile.com). By using any of our products/services or our website (collectively referred to below as “Services” or “Products”), you agree that a contract is concluded between you and the Company, which includes these Terms and Conditions as an integral part.
By using the Company’s Products, you express your agreement with these Terms and Conditions. If you do not agree with these Terms and Conditions, do not use our website and/or the Company’s Services/Products. The Company may change these Terms and Conditions at any time, and these changes will become effective on the date the updated Terms and Conditions are published on the website. From that moment, the amended Terms and Conditions will become part of the agreement you have entered into with us and will apply to your use of our Services. If changes to the Terms and Conditions occur and you continue to use our website or any of the Company’s Services, this means you have accepted the amended Terms and Conditions.
- GENERAL INFORMATION ABOUT THE SERVICES/PRODUCTS
The Company owns the website destinationagile.com and is responsible for and owns the content on the website. Through the website, the Company provides the following services:
- Training with certification from third parties – providers of the respective training;
- Training with certification from the Company;
- Certification in various programs by the Company;
- Program for “Building Useful Work Habits”;
- Open study/work groups (Workshops).
The website offers various Products (also called “paid materials”) with a fee, such as: training, PDF files with text, text messages sent to an email provided by you in advance, provision and/or sharing of video files (videos/webinars on the YouTube platform, etc.), and other products aimed at organizational transformation.
Information from destinationagile.com may be viewed, downloaded to a personal computer/electronic device, and printed only for personal and non-commercial purposes by users of the website. The information from destinationagile.com cannot be altered, copied, published, modified in parts or in whole, distributed to other persons, or stored on another server by persons other than the Company without its explicit consent. The information from the website can be shared on other websites or platforms, provided that the shared link leads to the Company’s website and clearly shows that the shared content is owned by the Company.
Each of the Products, including paid materials that you can access through our website, has a stated price, and you (as well as any other user of our Services) can access them by making a payment of the stated price via debit/credit card or bank transfer if possible for the specified Service.
The Company reserves the right to update or adapt the content of the Services without prior notice.
- PAYMENT SPECIFICS FOR PRODUCTS/SERVICES
Payment for products from the “Program for Building Useful Work Habits” and their stated price guarantees the user fixed access for a thirty-day period to a specified number of text and video files. After confirming your payment for the respective Product (month), you will gain access to the resources on the first day of the month for which you paid, and from that moment, the period during which you can use the product begins. Users can choose to continue paying the monthly fee for subsequent periods, extending their access to certain Services indefinitely.
Payment for products such as “Training with certification from third parties – providers of the respective training,” “Training with certification from the Company,” or “Open study/work groups” and their stated price guarantees the user permanent access to the sent materials for the respective training/group.
- GENERAL PAYMENT TERMS FOR SERVICES
All training prices published on the Company’s website include VAT, meaning they are already taxed according to the applicable Bulgarian legislation at the given moment. If a user does not pay the price for the respective Product or Service, this will result in the termination of their access to the Company’s resources, as well as the cancellation of all current and future enrollments in the training offered by the Company and our website.
The website does not have access to our users’ credit/debit card data. Payment is made through electronic platforms providing electronic payment services through which you can make the payment to us. The data we receive upon payment to us are the usual data our bank shares with us in connection with administering and accounting for the respective payment.
- REFUND POLICY
The Company may refund the paid amount for Services only if the cancellation notice is sent by the respective User to the Company under the conditions and within the deadlines specified in these Terms and Conditions (see sections 8.1 and 8.2).
In cases where the Company refunds the course amount to the user, all transfer fees are borne by the user.
- ISSUANCE OF CERTIFICATE
A certificate for completed training is issued and provided only to users (participants in the respective training) who have attended at least 80% of the scheduled hours for completing the respective training (depending on the specific features relevant to the training).
Note: Users who have attended at least 80% of the time/study hours for training in programs such as ITIL, PRINCE2, PRINCE2 Agile, DevOps Foundation, Scrum, Kanban receive only a letter of attendance at the end of the course.
For courses from the SAFe Framework, data are submitted to Scaled Agile Inc. to access the certification exam conducted on their platform (the platform of Scaled Agile Inc.).
Each user/participant in a given training must possess the necessary prior knowledge and experience described in the training program for the respective training.
- SPECIAL FEATURES
The Company reserves the right to postpone or cancel training or other events in case of insufficient minimum number of participants, absence due to unforeseen circumstances, or other compelling reasons of the lead instructor for the respective training. In such cases, the respective users/participants in the training will be notified promptly and offered an alternative opportunity for conducting the training. Where possible, the Company may refund the paid amounts if the training will not be conducted and no other period for its conduct can be determined.
If the provision of the Company’s Services becomes impossible due to force majeure circumstances, paid amounts will not be refunded, and the Company is not liable for the complete or partial non-performance of its obligations in providing the respective Services. Force majeure circumstances that may hinder the provision of Services include fire, industrial accidents, military actions, natural disasters – storms, heavy rains, floods, hail, earthquakes, icing, drought, landslides, and other natural phenomena, embargo, government bans, strikes, riots, disturbances, power supply interruptions, internet access interruptions at the national level, etc.
Each of our users/participants in training, users of our Services declares that they accept the collection and processing of personal data to the extent necessary for the performance of the respective Services and the use of our Products.
Users/participants in training, users of our Services (collectively referred to below as “Users”) understand that the signed training contract represents an agreement between the Company and them or the company where they work or with which they have other contractual relations. Users are accountable for paying for the respective Services in a timely manner. The Company guarantees the provision of only those services specified in the respective individual agreement with the User or which are related to receiving the resources requested and paid for by a specific User.
- ATTENDANCE POLICY
If a User is late by 15 minutes for the first training session, their place in the training may be given to a standby participant. If a User is late by 30 minutes or more for the first training session, they will need to attend the training on another date if such can be provided by the Company. If an additional date cannot be provided by the Company, the respective User will record a non-attendance percentage of the total training hours for the specific training, which will be considered when issuing a certificate for completed training.
Each User is responsible for confirming their attendance.
Re-participation in a given training is allowed within six (6) months after the end of the first conducted training or according to the conditions of the respective training provider of the Company (third-party training provider) if they differ from the above-mentioned. When a User decides to retake training, they will be registered as a standby User, and their place will be confirmed if there are free spots in the respective training.
Note: The dates for holding open study groups are subject to change. Open study groups are discussion groups on a specific topic (workshops) usually lasting several hours in one day and may be both paid and free for participants.
- CANCELLATION/RE-ENROLLMENT POLICY FOR TRAINING/NON-ATTENDANCE
A User registered for training and wishing to cancel their participation must notify the Company as soon as possible before the start of the training at the following email: contactus@destinationagile.com to avoid penalties. If the Company refunds the course fee to the user, all transfer fees are borne by the user.
For open study groups (workshops), a ten (10) working days’ notice is required for cancellation or rescheduling to avoid penalties.
For training where certification is provided, a five (5) working days’ notice is required for cancellation or rescheduling to avoid penalties.
In case of non-attendance or cancellation by a User with less than five (5) working days’ notice before the start date of the first session of the respective training, 100% of the course price will be due on the date specified in the original invoice issued by the Company. If the initial course was paid for with a discount voucher, this voucher and the conditions (discount) it offers are only valid for the terms described in the voucher itself.
Cancellation Policy for “Program for Building Useful Work Habits”
Cancellation can be made at any time during the respective month, with the user liable for the month’s fee if it has started.
Certification Exam Attendance
If a certification exam is included as part of the training, the user must take the exam within 30 days after the course start date. If the exam voucher is not used within 30 days, it expires, and the user must purchase a new exam directly from the respective exam provider’s website.
8.1 Specialized Course, On-site Training
If a user wishes to cancel on-site training, a specialized course, they must notify the Company as soon as possible via email at contactus@destinationagile.com to avoid penalties. If the cancellation notice is sent less than 15 business days before the scheduled date, 100% of the training fee will be due on the date specified in the original invoice issued by the Company.
8.2 No-Show Policy
If a user fails to notify their intention to cancel their participation in the training, 100% of the training fee will be due on the date specified in the original invoice issued by the Company.
- Miscellaneous
The Company reserves the right to review the policies applicable to its Services on an annual basis. If necessary, these policies may be modified, updated, or completely revoked. All changes will be made to best meet the expectations of our Users, incorporate feedback provided, and adapt to new conditions and best practices in our work.
- Disputes
If you are dissatisfied with the Services provided, lack sufficient information about our Products, or are otherwise dissatisfied, please send your concerns, requests, opinions, and/or suggestions to contactus@destinationagile.com.
All your messages under this section will be promptly and impartially reviewed by us, and all possible measures will be taken to meet your expectations.
We encourage you to report any incorrect data provided to training providers, exam providers, or certification organizations. Reporting helps us promptly correct data where possible, in accordance with the provider’s policies. Each external provider may have different service and personal data policies requiring additional direct communication between you and the provider. When using third-party services, platforms, and exams, their terms of use and policies apply.
In case of a dispute or disagreement regarding how we recorded your absence, cancellation notice, non-participation, delay, payment, etc., please do not hesitate to contact us at the following email: contactus@destinationagile.com. We will do our best to provide you with our opinion and the data recorded and reported by us.

Version of the Terms and Conditions
These Terms and Conditions are updated and effective from the date 1.08.2024. Changes may be made to the Terms and Conditions in response to legislative changes, privacy policies, cookie policies on the website, technical capabilities of the website, the type, scope, and specifics of our services, or our work processes.
